Terms of Service
Last updated: 27 October 2026
These terms cover use of NextGen Pay websites and software (“Service”). NextGen Pay is a trading name of NextGen Testers Limited. By creating an account, starting a trial, or using the Service, you agree to them.
The Service
We provide multi-tenant QR ordering, Kitchen Display, and restaurant management software, including Pay by Bank and Pay by Card.
Accounts & venues
You must provide accurate account information and keep credentials and staff PINs confidential. You are responsible for activity under your venue accounts and for menu/pricing accuracy shown to guests.
Fees & trial
Published software plans are on Pricing. Your business’s NextGen Pay fee schedule (the Pay by Bank and Pay by Card fees, your agreed term, and any monthly platform fee) is shown in Settings and must be accepted before you turn either payment option on. For Pay by Card, NextGen Pay’s fee is billed on top of what Stripe charges your connected account. After the sixty-day trial, fees are billed monthly in arrears. We send your invoice by the 5th; payment is due by the 15th. Amounts are in NZD and exclude GST, which we add where it applies. We change your fee schedule only with your acceptance in Settings. Until you accept a new schedule, Pay by Bank and Pay by Card stay off. When Stripe Billing is enabled, trials and renewals may be managed automatically according to the checkout you complete. Access continues through the paid period already settled unless we agree otherwise in writing.
Invoices & late payment
After the trial, we send each month’s invoice by the 5th of the following month. Payment is due by the 15th. If you think an invoice is wrong, tell us before the due date. We will not take late-payment steps on the amount in question while we look at it. Please pay the rest on time.
If an invoice is not paid by the due date, we will email the account owner. If it is still unpaid 5 business days after that email, we may pause Pay by Bank and Pay by Card for your business until it is paid. The monthly platform fee still applies while payments are paused. We turn payments back on within one business day of receiving payment in full. If it is still unpaid 20 business days after payments were paused, we may end the Service for your business by email.
We do not charge interest on late payments. You agree to pay reasonable costs we incur to recover overdue amounts, including debt collection costs.
Term & cancellation
Your fee schedule shows your agreed term. No fixed term means you can cancel any time. The Service ends at the end of that calendar month, and we invoice fees up to then. A fixed term starts on the day you accept the fee schedule. When it ends, the Service continues month to month on the same schedule until either of us cancels. If you cancel during a fixed term, the monthly platform fee for the remaining months is due on your final invoice. Percentage fees stop when your payments stop. To cancel, email us from the account owner’s address.
Ending the Service
We may end the Service for your business: with 30 days’ notice for any reason; after the late-payment steps above; straight away for a serious breach of these terms or the BlinkPay Client Service Agreement; or if BlinkPay or Stripe stop providing their service to your business. If we end the Service with 30 days’ notice, or because a payment partner stopped serving you, no early-cancellation fee applies. When the Service ends, all unpaid fees are due. We keep payment records for as long as the law and our payment partners require. If you ask within 90 days, we will send you a copy of your order and payment records.
Pay by Bank (BlinkPay terms)
Pay by Bank is processed by Blink Pay NZ Limited (“BlinkPay”). By accepting the BlinkPay customer terms in Settings or enabling Pay by Bank, your business agrees to be bound by the BlinkPay Client Service Agreement (current version v3.0, as updated by BlinkPay from time to time). To the extent of any inconsistency between these terms and the BlinkPay Client Service Agreement in relation to Pay by Bank services, the BlinkPay Client Service Agreement prevails.
Acceptable use
Do not abuse the Service, attempt to access other tenants’ data, interfere with security, or use the Service for unlawful activity. We may suspend accounts that create risk for diners, venues, or the platform.
Data & privacy
Our Privacy Policy explains how personal information is handled. Order and menu data belongs to the venue; we process it to provide the Service.
Availability
We aim for reliable service but do not guarantee uninterrupted uptime. Network or third-party outages (including payment partners) can affect ordering. Design your floor process for graceful fallback.
Liability
To the maximum extent permitted by NZ and Australian consumer law, the Service is provided “as is”. We are not liable for lost profits, lost orders attributable to venue network failure, or indirect damages. Nothing in these terms limits non-excludable consumer guarantees.
Changes
We may update these terms; material changes will be posted on this page with a new date. Continued use after the effective date constitutes acceptance.
